Slovenia – Family member

Your family member(s) must obtain a temporary residence permit for the purpose of family reunificationSearch for available translations of the preceding link

If you reside in the Republic of Slovenia on the basis of a permanent residence permit or if you resided last year in the Republic of Slovenia on the basis of a temporary residence permit and you have a valid temporary residence permit issued for at least one year (except a single permit for seasonal work or cross-border work), you become entitled to family reunification with the following family members:

  • your spouse, partner in a civil partnership or civil union or partner with whom you are in a long-term relationship;
  • your unmarried minor children;
  • the minor unmarried children of your spouse, a partner in a civil partnership or civil union or partner with whom you are in a long-term relationship;
  • your parents, if you are a minor and you have resided with them in a family community before your arrival to the Republic of Slovenia;
  • your adult unmarried children and parents of yours, spouse, a partner in a civil partnership or civil union or partner with whom you are in a long-term relationship, whom you, your spouse, partner in a civil partnership or civil union or partner with whom you are in a long-term relationship is obliged to maintain under the Acts of his or her country of citizenship.

In exceptional cases, the competent authority may deem another relative of yours to be a family member if special circumstances justify family reunification in the Republic of Slovenia. In the event of a polygamous marriage, a residence permit for the purpose of family reunification may only be issued and extended to one spouse.

If you reside in the Republic of Slovenia on the basis of a temporary residence permit for the purpose of seasonal work or as a cross-border worker you do not have a right to family reunification with your family members.

If you are a holder of an EU Blue Card, a temporary residence permit for work in research and higher education, a single intra-corporate transferee permit in accordance with Articles 45b and 45d of the Foreigners Act, a temporary residence permit in the interests of the Republic of Slovenia (which shall be decided by the authority responsible for issuing the permit based on the opinion of the responsible ministry or another state authority), you may reunite with family members without limitations regarding the length of your residence in the Republic of Slovenia or the validity of your permit.

Fees

The administrative fee for issuing a first temporary residence permit is 102 EUR, if the application is lodged at a diplomatic mission or consular post of the Republic of Slovenia abroadSearch for available translations of the preceding link

The administrative fee for issuing a temporary residence permit is 50 EUR, if the application is lodged at the administrative unitSearch for available translations of the preceding link in the Republic of Slovenia.

The price of the residence permit card is 12 EUR.

Application form

An application for the issue or renewal of a temporary residence permit for the purpose of family reunification shall be made using the form no. 14/1 set out in Annex 1 of the Rules on issuing residence permits, the method of capturing fingerprints and the modalities of the termination of the residence permit.

A third-country national with a valid temporary residence permit or long-stay visa who does not reside with an accommodation provider or host shall register temporary residence at the address where he or she temporarily resides with the administrative unitSearch for available translations of the preceding link within eight days of the day of taking up temporary accommodation, while a third-country national who already resides at the address and obtains a temporary residence permit or long-stay visa after taking accommodation at this address shall register within eight days of his/her service.

Duration of validity of permits

Your family member’s residence permit is issued for the duration of the validity of your residence permit, but not for more than one year.

It is renewable for the duration of validity of your residence permit, but not for more than two years.   

If you have a permanent residence permit, a residence permit for a family member is issued for one year and can be extended for a two-year period. 

The temporary residence permit of a family member of a holder of an EU Blue Card shall be issued and extended with validity equal to his or her EU Blue Card.

The temporary residence permit of a family member of a third-country national who has acquired a permanent residence permit as a holder of an EU Blue Card shall be issued and extended for three-year periods.

A temporary residence permit for the purpose of family reunification may not be issued or extended with regard to minor unmarried children of the spouse, partner in a civil partnership or civil union or partner with whom the third-country national is in a long-term relationship or to the parents of a minor third-country national for a period that extends beyond the child’s age of majority.

Conditions for renewal

A family member’s temporary residence permit for the purpose of family reunification may be extended under the same conditions as those applicable to its issuance. Sponsor must apply for the extension of a permit with the competent authoritySearch for available translations of the preceding link in the Republic of Slovenia prior to the expiry of the permit.

Appeals

Decisions of the administrative unit may be challenged before the Ministry of the InteriorSearch for available translations of the preceding link.

Access to employment

Non-EU citizens who reside in Slovenia on the basis of a residence permit for the purpose of family reunification have, in principle, the same access to employment as other non-EU citizens.

The Employment Service shall decide on the right to access the labour market for a third-country national who resides in the Republic of Slovenia on the basis of a temporary residence permit that was not issued for the purpose of employment, self-employment or work, in the procedure and under the conditions laid down in the Act governing the employment and work of foreignersSearch for available translations of the preceding link.

On the basis of a decision on the right to access the labour market referred to in the preceding paragraph, the competent administrative unitSearch for available translations of the preceding link in the area of a third-country national’s residence shall replace, ex officio, the residence permit card with a new card, on which the right to access the labour market is indicated. The competent administrative unitSearch for available translations of the preceding link may indicate the right to access the labour market on the residence permit card also in the procedure for issuing and extending a temporary residence permit issued for another purpose, such as employment, self-employment or work if a third-country national complies with the conditions and has the right to free access to the labour market in accordance with the Act governing the employment, self-employment and work of foreignersSearch for available translations of the preceding link.

Change of employment

Family members with the temporary residence permit for the purpose of family reunification must obtain from the Employment Service a new official information document specifying all the conditions and elements of the new employment defined by the employer. All the conditions and elements of the employment specified in the official information document shall be complied with throughout the employment relationship.

Change of status

If a family member wishes to change status and reside in Slovenia for a reason other than family reunification, he or she may apply for a further temporary residence permit. This must be done before the expiry of the original temporary residence permit.

In-country applications are possible.

Long-term residence

After five continuous years of legal residence on the basis of a temporary residence permit, your family member is entitled to obtain a permanent residence status. 

Family members of a third-country national who possesses a permanent residence permit in the Republic of Slovenia may be issued with permanent residence permits following two years of continuous legal residence in the Republic of Slovenia on the basis of a temporary residence permit or a certificate of the renewal or granting of a subsequent temporary residence permit.

Pending a decision on the application for a permanent residence permit, your family member must reside in the Republic of Slovenia on the basis of a temporary residence permit.
