Finland – Intra-corporate transferee (ICT)

You work for a company established outside the European Union (EU) and you are going to be transferred to a branch in Finland? You can find information below on the conditions, procedures, rights and mobility you can enjoy during your stay.

You can enter, reside and work in Finland as an intra-corporate transferee if you are a manager, specialist or trainee employee. The definitions and conditions of admission are governed by the EU Directive on intra-corporate transfer (Articles 3 and 5 of Directive 2014/66/EU).

If you fulfil the conditions, you will be issued an intra-Corporate Transferee permit.

Please note that before being transferred from a company branch located outside of the EU to a branch in Finland you must have been employed by that company for a certain time period: if you are a manager, a specialist or a trainee: 3 months.

 

Where and how to apply
  • Submit your application in the e-service Enter Finland. After you have submitted your application, you have to visit the Finnish diplomatic mission or consulate in your country of origin/residence to prove your identity and have your fingerprints taken. A paper application is submitted to the Finnish diplomatic mission or consulate in your country of origin/residence;
  • You have to submit your application yourself. Your host entity cannot do it for you.
  • Processing fee (EUR): online application: 350, paper application: 550;
  • Expected processing time is 90 days;
  • You will be informed of the decision online or through the Finnish diplomatic mission or consulate. You will receive your residence card through the Finnish diplomatic mission or consulate.
Documents required

General attachments

  • Valid passport (you must present it when you submit the residence permit application);
  • passport photo complying with the photo guidelines issued by the police or a photograph retrieval code you received from a photo shop;
  • color copies of the passport page containing personal data and of all passport pages that contain notes;
  • document showing that you are legally staying in the country where you submit the application;
  • Form MP_1 (if you already are in Finland and apply for your first residence permit).

Application-specific attachments

  • Document that proves the home and host entities are a part of the same company or group of companies;
  • document proving that you have professional qualifications for specialist or executive work and that you have been employed by the same company or group of companies for at least three months without interruption or;
  • document proving that you are coming to work as a trainee employee at the host entity and that you have been employed by the same company or group of companies for at least three months without interruption. Attach a certificate of your higher education degree to your application.
  • Employment contract and assignment letter
    • Employment contract and assignment letter must include the following information:
      • principal terms and conditions of work,
      • duration of the transfer,
      • document proving that you can return to the home entity after your transfer,
      • document proving that the work is intended for an executive, a specialist or a trainee employee.
Further requirements

If possible, specify if there are any additional requirements that the applicant shall fulfil after arrival, e.g. collect the residence permit, register with the municipality, tax office, health services etc.

Duration of validity of permits

The period of validity of the ICT permit is the duration of the transfer and may be extended to a maximum of 3 years for managers and specialists and 1 year for trainee employees.

After the maximum period the transferee will need to leave the territory of Finland if he/she is not granted a residence permit on some other ground.

Appeals

It is possible to appeal the decisions made by the Finnish Immigration Service before an Administrative Court within the 30 days following the notification. The appeal procedures are indicated in the decision.

A rejection from the Administrative Court can be appealed as a last resort to the Supreme Administrative Court. You will need to apply for leave to appeal.

Extension or renewal

If you are a manager or specialist and transferred for longer than three years, you must have a residence permit for an employed person.

If you are a trainee employee and transferred for longer than one year, you must have a residence permit for an employed person.

 

Change of status

The transferee and the host entity should inform the Finnish Immigration Service of all the changes during the stay in Finland.

Family members

Family members apply for a residence permit on the grounds of family ties The residence permit includes the right to work without restrictions.

Other rights

A person with an ICT permit benefits from equal treatment with nationals of Finland in what regards freedom of association; recognition of diplomas and professional qualifications; provisions regarding social security (with conditions); access to goods and services (with exceptions).

 

 

Upon the fulfilment of certain conditions you can, on the basis of an ICT permit issued in one EU country, work in other EU countries if the entity where you will work belong to the same company. If the duration of your mobility is shorter than 90 days during a 180-day period you are subject to short-term mobility rules. If the duration of the mobility is longer than 90 days, you are instead subject to long-term mobility rules.

The following procedures apply if you have an ICT permit in an EU Member State and intend to move and work in Finland.

Short-term mobility

The host entity in Finland submits a mobility notification to the Finnish Immigration Service with regard to an intra-corporate transfer (ICT) of a person to Finland. The notification can be submitted when the employee is applying for an ICT residence permit in another EU Member State, if the mobility to Finland has already been planned at the moment of applying or after the employee has been granted entry into another EU Member State and the mobility to Finland is known.

The transferee must have an ICT residence permit issued by another EU Member State, or must be applying for an ICT residence permit in another EU Member State. The transferee must meet the conditions for mobility and be transferred to Finland to work for a period of up to 90 days in any 180-day period.

The Finnish Immigration Service does not issue certificates of freedom of movement. The Finnish Immigration Service will only notify the host entity if the agency objects to the mobility.

The notification form is submitted to the Finnish Immigration Service.

Required documents and information

  • Color copy of the page containing personal data in the transferee’s valid passport,
  • copy of an ICT residence permit granted by another EU Member State, covering the whole period of the transferee’s stay in Finland
  • documentation showing that the host entity in Finland and the company established in a third country belong to the same company or group of companies,
  • the employment contract and, if necessary, the assignment letter from the employer that were delivered to the first EU Member State in which the ICT residence permit was applied for,
  • documentation showing the planned duration and dates of the mobility, if not specified in any of the above-mentioned documents,
  • where applicable, documentation showing that the intra-corporate transferee fulfils the conditions for EU citizens in Finland to exercise the regulated profession to which the application relates
Long-term mobility

If you have been issued a residence permit on the basis of intra-corporate transfer by another EU country, you may apply for a permit for long-term mobility (Mobile ICT). Submit your application in the e-service Enter Finland. After you have submitted your application, you have to visit the Finnish diplomatic mission or consulate in your country of origin/residence or, if you are in Finland, at a service point of the Finnish Immigration Service, to prove your identity and have your fingerprints taken. A paper application is submitted to the Finnish diplomatic mission or consulate in your country of origin/residence or, if you are in Finland, at a service point of the Finnish Immigration Service.

You have to submit your application yourself. Your host entity cannot do it for you.

The processing fee is 350 € for an electric application and 550 € for a paper application.
