Lithuania – Intra-corporate transferee (ICT)

You work for a company established outside the European Union (EU) and you are going to be transferred to a branch in Lithuania? You can find information below on the conditions, procedures, rights and mobility you can enjoy during your stay.

You can enter, reside and work in the Republic of Cyprus as an intra-corporate transferee if you are a manager, specialist or trainee employee. The definitions and conditions of admission are governed by the EU Directive on intra-corporate transfer (Articles 3 and 5 of Directive 2014/66/EU). If you fulfil the conditions, you will be issued an intra-Corporate Transferee permit.

Please note that before being transferred from a company branch located outside of the EU to a branch in Lithuania you must have been employed by that company for a certain time period: if you are a manager for 6 months; a specialist for 6 months; a trainee for 3 months.

Where and how to apply

You should apply for a temporary residence permit at the Lithuanian embassy or consulate outside the territory of the EU. Please note that your host entity is also entitled to submit the application for a temporary residence permit.

Since you have submitted the application for a temporary residence permit you can apply for a national long-term visa that will be issued for a period of up to 5 months. In this case you may stay in Lithuania while your application for a temporary residence permit is being examined and, in case of issuance, collect your residence permit.

The decision to issue the residence permit is taken within 2 months at the latest in case you are a manager or a specialist and within 3 months in case you are a trainee. For an additional fee, the decision will be taken within 1 or 45 days respectively.

Documents required

To obtain a temporary residence permit you must submit the following documents:

  • an application for issuing a temporary residence permit to reside in the Republic of Lithuania in the established format;
  • a valid travel document (passport);
  • a temporary residence permit (in case of renewal);
  • a document confirming your legal stay, if you apply in Lithuania;
  • the number of a mediation letter that was electronically filled in and submitted by your host entity;
  • a document confirming that you have accommodation where you intend to declare residence;
  • a document confirming that you have enough funds (e.g., a bank account statement) and (or) receive regular income to live in the Republic of Lithuania;
  • a document confirming health insurance (insurance sum 6000 Eur);
  • (a) certificate(s) from (a) competent authority(ies) of (a) foreign state(s) where you lived before coming to the Republic of Lithuania and (or) currently live for the last 2 years, confirming that you were (not) convicted in the corresponding state(s) (only in case of issuance the first temporary residence permit);
  • a list of trips and stays in foreign states;
  • evidence that the host entity and the undertaking established in a third country belong to the same undertaking or group of undertakings;
  • a work contract with the undertaking established in a third country;
  • an assignment letter from the undertaking established in a third country;
  • if you intend to work in a host entity according to the regulated profession – a document confirming that you meet the conditions established by the legal acts of the Republic of Lithuania to carry out regulated professional activity.

If you apply for a residence permit as a manager, you must additionally submit:

  • evidence that you are taking a position as a manager in the host entity or its structural unit;
  • evidence that you have the professional qualifications and experience needed in the host entity to which you are transferred as manager;
  • evidence of employment within the same undertaking or group of undertakings established in a third country, from at least 6 uninterrupted months immediately preceding the date of the intra-corporate transfer.

If you apply for a residence permit as a specialist, you must additionally submit:

  • evidence that you have the professional qualifications and experience needed in the host entity to which you are transferred as specialist;
  • evidence of employment within the same undertaking or group of undertakings established in a third country, from at least 6 uninterrupted months immediately preceding the date of the intra-corporate transfer.

If you apply for a residence permit as a trainee, you must additionally submit:

  • a training agreement;
  • evidence that you have a university degree;
  • evidence that you will get the remuneration;
  • evidence of employment within the same undertaking or group of undertakings established in a third country, from at least 3 uninterrupted months immediately preceding the date of the intra-corporate transfer.

In order to issue the document, your biometric data will be taken – 2 fingerprints and the face image.

Further requirements

If you receive a positive decision and are outside the country, you will be issued a single entry national visa, if necessary, and you will be able to enter Lithuania and collect your residence permit here.

When you obtain a temporary residence permit, you must declare your place of residence.

If you hold a temporary residence permit, you must, not later than within 7 days, notify the Migration department in the event of: change of documents confirming your identity or citizenship; change of your family situation; change of your place of residence.

If you hold a temporary residence permit, you must, not later than within 7 days, notify the Migration department in the event of: change of documents confirming your identity or citizenship; change of your family situation; change of your place of residence; change of the registered office address of your host entity/company entered on the Register of Legal Entities where the temporary residence permit has been issued to you as a manager.

Duration of validity of permits

The period of validity of the ICT permit is 3 years for managers and specialists and 1 year for trainee employees or the duration of the transfer (whichever is shorter).

An intra-corporate transfer, including movement between host entities established in other Member States of the European Union, may not last more than 3 years if you are being transferred as a manager or a specialist and may not last more than one year if you are being transferred as a trainee. After this period, you will need to leave Lithuanian territory for 3 months before being able to apply for a new ICT permit.

Appeals

You will be notified on the decision via the e-mail address, submitted in your application.

Decisions can be challenged before the Vilnius District Administrative Court within 14 days from the receipt of the decision and further before the Supreme Administrative Court.

Extension or renewal

You may apply for the renewal of a temporary residence permit, if an intra-corporate transfer, including movement between host entities established in other Member States of the European Union, did not last more than 3 years if you were being transferred as a manager or a specialist and did not last more than one year if you were being transferred as a trainee.

An application for the renewal of a temporary residence permit must be submitted to the Migration department’s territorial division. Application and required documents for the renewal of a temporary residence permit in general order shall be submitted at least 2 months in advance but not earlier than 4 months before the expiry of the current permit. Application and required documents for the renewal of the temporary residence permit on a matter of urgency shall be submitted at least 1 month before the expiry.

The decision to renew the residence permit is taken within 2 months at the latest. For an additional fee, the decision will be taken within 1 month at the latest.

Change of status

If conditions for issuing a temporary residence permit have changed and you are no longer eligible for the temporary residence permit, you must leave the Republic of Lithuania and your temporary residence permit will be revoked. However, if you express a wish to reside in the Republic of Lithuania, you may be granted temporary residence permit on other grounds. In this case, you need to apply for a new temporary residence permit.

Family members

Your family members have the right to apply for a temporary residence permit. Family members include: spouse, registered partner, unmarried and dependent minor children, your dependent parents if you have retained them for at least 1 year and they cannot benefit from other family members living abroad.

Your family members can apply for a temporary residence permit at the same time as you. They will be issued a temporary residence permit for the same period as your temporary residence permit.

Your family members must fill in the application for a temporary residence permit, pay the state fee and submit the documents, listed in the section Family members – Documents requiredSearch for available translations of the preceding link.

Your family members are entitled to work in the Republic of Lithuania during the period of validity of the temporary residence permit. They are exempt from the obligation to obtain a work permit.

Other rights

A person with an ICT permit benefits from equal treatment with nationals of Lithuania in what regards freedom of association; recognition of diplomas and professional qualifications; provisions regarding social security (with conditions); access to goods and services (with exceptions).

Upon the fulfilment of certain conditions you can, on the basis of an ICT permit issued in one EU country, work in other EU countries if the entity where you will work belong to the same company. If the duration of your mobility is shorter than 90 days during a 180-day period you are subject to short-term mobility rules. If the duration of the mobility is longer than 90 days, you are instead subject to long-term mobility rules.

The following procedures apply if you have an ICT permit in an EU Member State and intend to move and work in Lithuania.

Short-term mobility

If you have a valid temporary residence permit issued by another Member State of the European Union as an intra-corporate transfer, you have the right to enter and stay without a notification in the Republic of Lithuania for a maximum of 90 days within 180 days, as well as to work in the host entity established in the Republic of Lithuania.

If you have a valid temporary residence permit as an intra-corporate transfer issued by another Member State of the European Union that is not a Schengen State, then the host entity established in the Republic of Lithuania must submit your transfer by a written notice to the Migration Department no later than 30 days before the planned transfer.

Long-term mobility

If you have a valid temporary residence permit issued by another Member State of the European Union as an intra-corporate transfer, and you intend to enter the host entity established in the Republic of Lithuania for more than 90 days within 180 days, you must apply for a temporary residence permit.

You should apply for a temporary residence permit at the Lithuanian embassy or consulate within the territory of the European Union. Please, note that your host entity/organization is also allowed to submit the application.

To obtain a temporary residence permit you must submit the following documents:
